It’s difficult to hear about Obamacare these days and not hear about the exemptions and waivers that are included with the plan. Though some may see these exemptions and waivers as a means of creating unfairness between classes, the fact is that Obamacare does its best to make these new laws meet individual requirements that may exist.
The 6 Types of Waivers and Exemptions
1. Waiver for Mini-med Health Insurance Plans
Organizations that have a high turnover rate have what are called “mini-med” plans. McDonald’s is one of the largest employers that institutes these temporary health insurance policies. Because of the higher levels of cost associated with these plans with the implementation of Obamacare, they were given a waiver.
2. Annual Limit Waiver
Under Obamacare, health insurance plans cannot set lifetime limits on personal health care benefits that have been received. There is also a waiver on the aforementioned mini-med plans so that these workers don’t have to pay more than their share of anticipated health care costs when compared to others in more traditional forms of employment.
3. Waiver for States
States can apply for a waiver if it is believe the state’s loss ratios will destabilize the insurance market itself.
4. State Innovation Waiver
In the United States, although no state is considered to be more important than the nation itself, there are states’ rights in play in all legislation. Because of this, there is an innovation waiver in place with Obamacare that says if a state can come up with a better overall system that includes the care components that exist in this new law that the state will become exempt from the national law.
5. ACO Waivers
ACO’s are Affordable Care Organizations and there was initially some requirements under Obamacare that would need to be met regarding the implementation of healthcare. In 2011, some of the requirements were exempted from the plan if certain conditions could be met. Keep in mind that this specific waiver is about delivery of the product, not about insurance itself.
6. Individual Mandate Waivers
If you are a First Nations/Native American, have certain and established religious objections, are in the country illegally, are in prison, are part of a health care sharing ministry, are too poor to afford new insurance, or are in a temporary hardship, then you may qualify for an exemption.
